1. Definitions
“Custom-made Products” refers to blinds and window coverings manufactured specifically to the measurements, colours, and design specifications provided by you.
“Ready-made Products” refers to pre-manufactured products sold in standard sizes.
2. Orders and Measurements
Order Acceptance: All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order at our reasonable discretion (e.g., due to material unavailability).
Customer Measurements: If you are providing your own measurements for Custom-made Products, you are entirely responsible for the accuracy of these measurements. Blindsmith Ltd will not be held liable, nor will we offer refunds or free remakes, for products that do not fit due to incorrect measurements provided by the customer.
3. Pricing and Payment
All prices displayed on our website are in New Zealand Dollars (NZD) and are inclusive of Goods and Services Tax (GST at 15%), unless otherwise stated.
We reserve the right to change prices at any time without prior notice. However, price changes will not affect orders that have already been paid for and confirmed.
Full payment is required at the time of order placement. Manufacturing of Custom-made Products will not commence until payment has been received and cleared in full.
4. Consumer Guarantees Act 1993 & Refund Policy
We respect your rights under the New Zealand Consumer Guarantees Act 1993 (CGA). Nothing in these Terms and Conditions limits or excludes your legal rights under the CGA.
Quality Guarantee: Our products will be of acceptable quality, match their description, and be fit for purpose. If a product has a major fault, you are entitled to a repair, replacement, or refund under the CGA.
Custom-made Products: Due to the bespoke nature of Custom-made Products, we strictly do not offer refunds, returns, or exchanges for “change of mind” once production has commenced.
Ready-made Products: We may accept returns for Ready-made Products if they are returned in their original, unused condition and packaging within [14] days of receipt. Return shipping costs are the responsibility of the customer.
5. Delivery and Title
We will make every effort to deliver your products within the estimated timeframes; however, delays may occur due to external factors beyond our control. We are not liable for any losses caused by delivery delays.
The risk of loss or damage to the goods passes to you upon delivery to your specified address. Legal title and ownership of the goods remain with Blindsmith Ltd until full payment has been received.
6. Intellectual Property & Website Use
Unless otherwise stated, Blindsmith Ltd and/or its licensors own the intellectual property rights for all material on this website, including but not limited to text, images, logos, and blind designs. All intellectual property rights are reserved.
You may view and print pages from our website for your own personal use, subject to restrictions set in these terms. You must not republish, sell, rent, sub-license, reproduce, or redistribute material from Blindsmith Ltd without our prior written consent.
7. Privacy and Cookies
We comply with the New Zealand Privacy Act 2020. By using our website, you consent to the collection and use of your personal information and cookies as outlined in our Privacy Policy.

To the maximum extent permitted by applicable New Zealand law (including the CGA and Fair Trading Act 1986):

We accept no liability for any personal injury, property damage, or product failure resulting from incorrect installation by you or a third party, or from misuse of the products.
